Apple Beats Samsung in Court: Will Microsoft Benefit as Well?

The mammoth Apple vs. Samsung case has been decided and Apple has emerged a strong victor as the jury ruled that Samsung copied Apple’s iPhone look and feel and awarded Apple $1.049 billion. An appeal is expected on Samsung’s part.

Apple is expected to ask the judge to triple the damages, to roughly $3 billion since the jury unanimously found that Samsung willfully violated Apple’s patents. Among the technologies copied were the ability to zoom text at the touch of a finger and to “bounce back” when scrolling off the page.

The judge has set a late September date for hearing Apple and Samsung’s points, including Samsung’s request to throw out the verdict and Apple’s request to ban importation of a range of Samsung devices.

The victory is widely viewed as having the potential to provide a damper on the smartphone and tablet markets which have seen explosive growth in the past few years by increasing licensing costs and slowing the adoption of new technologies.

The company that appears to be the most impacted by the decision is not Samsung but rather Google, who provides the Android ope

rating system that features some of the technologies that were at issue in the case. The question that many are wondering now is will developers seek indemnification from Google to shield them from potential Apple lawsuits?

The flip side of this is that a potential winner, aside from Apple, is very likely Microsoft, which will soon be pushing its new operating system for smartphones. Microsoft has a patent licensing agreement with Apple that also features an anticloning caveat that prevents Microsoft from delivering a knockoff of Apple’s look and feel.

There are plenty of comments now that this will have a tremendous impact on the market, and could hamper the growth of smartphones as developers have to find ways to either skirt Apple’s patents in their own development or work out licensing agreements with the company.

However the other side of this seems to me that it also opens the door to additional innovation, by forcing developers to look at the issues from a new point of view. This hopefully could lead to a new wave of products that offer features that might not be available today.

The case, originally filed in 2011, revolved around several issues. Apple claimed that Samsung violated a number of its patents and that Samsung closely copied its iPhones and iPads. The jury came down heavily in Apple’s camp, finding a wide range of devices, but not all, had violated a number of Apple patents.

Samsung had its own suit against Apple, claiming that Apple used its wireless technology improperly and was asking for $399 million. It lost its suit. This will obviously not be the end of this as the two have lawsuits against each other in South Korea, Germany, Japan, Italy, the Netherlands, Britain, France and Australia and Samsung is set to appeal the verdict if the judge does not.

Friday Grab Bag: Apple/Samsung Jury Forms, NFL Cutdowns, Kindle Loses Big Sale

Now that it has decided to test expanded replay, Major League Baseball is testing a pair of systems to see which will better meet its needs which will now include examining fair/foul calls and trapped balls.

MLB will have one system installed at Yankee Stadium and the other at the Mets' Citi Field in order to conduct tests. The systems are expected to be up and running by the end of this month and will be used in September games, according to Yahoo Sports.

Google Nexus 7 sales to hit 7 million
A report has surfaced from Tech-thought.net that said it estimates that Google will sell as many as 7 million of its Nexus 7 tablets this year, an amazing feat that would put it in among the leaders in tablet sales.

That number would be more than twice what Google had originally estimated it would sell, but demand has been strong and in the first weeks it sold out of its entry level model that starts at $199.

Now that the NFL season is around the corner its time to look at one important aspect of the games — the announcers. I find most announcers to be pretty grating and often watch games on mute rather than expose myself to their blather.

Some brave souls not only listen, but rate them with the pros. So head over to Awful Announcing and lend a hand. The site also does nice work covering many aspects of sports.

Microsoft to build 3 million Surface tablets in 2012?
Market research firm IDC said that it expects Microsoft to build 3 million Surface tablets in 2012, according to an interview run in C/net. The estimate includes tablets that run Windows 8 Pro and Windows RT.

In the interview with IDC analyst Bob O’Donnell C/net reported that he believed that the entry level price of at least one version of the tablets would be in the $199 range, putting it in a head to head price competition with the smaller 7-inch tablets and making it much less expensive than offerings from Apple and Samsung.

America’s Cup World Series mishaps

Dell not as enthusiastic on Surface sales
Dell executives said that the company expects that Microsoft’s Surface tablets will represent a very small percent of the overall PC units in the next year. Michael Dell, founder and CEO said that he expects the numbers to be between 1% and 2%.

The company has reported that its PC and mobility sales were down 14% for the most recent quarter and sees tablets as eroding that space. The company will be among the hardware developers expected to deliver Windows 8-based tablets in the fall.sales have been

ESPN bids on BCS playoffs
Now that the BCS has altered its championship format to now feature a playoff, the next step is of course to sell the rights to broadcast those games. ESPN has been broadcasting the BCS Championships the past few years and it has the opportunity to continue.

It has been reported that starting Oct 1, ESPN will have an exclusive 30-day window in which to purchase the playoff rights from the BCS. The BCS is also working on a new revenue-sharing plan to work out how the playoff money will be divided.

The form that the jury is using for the case is 20 pages long and looks like a college exam. I really feel sorry for the jury and expect that they will need to constantly have to get refreshers on what all of the varied elements are in the case.

Huge U.S. Government Kindle purchase killed
ITWorld is reporting that the U.S. Department of State has canceled a large order for Amazon’s Kindle Touch tablets along with additional content. The order was valued at $16.5 million over the course of its lifetime.

The department said that it was taking a second look at the requirements of the program and was conducting additional market research. The contract originally called for an initial 2,500 e-readers and 50 titles of content.

NFL roster reductions start Monday
For NFL fans some of the most interesting days, prior to when they actually start playing, will be coming up over the next week as teams will have to reduce rosters from the current 90 player level to 53 by Aug. 31.

Teams will be looking to shore up perceived weak areas as a flood of players hit the market with the first cut down next Monday to 75 and then again later in the week. I wonder how many might find a place in the USFL or other alternative leagues?

Major League Gaming Summer Championships Start Tonight

If you are a top gamer and are looking for glory then this weekend the place you should be is in Raleigh, North Carolina when the Major League Gaming Summer Championships start today with winners crowned at the end of the three day event.

There will be four different games all of which will be broadcast and you can look on the web site here to see what times and streams the game that you might be interested in will be playing. The first of the games starts with StarCraft II followed by League of Legends, Mortal Kombat and Soul Calibur V.

The StarCraft II tournament will have both Group play and a huge open bracket and will be playing for a total of $76,000 in prize money. The other matches will include the top competitors from the past season as well as some hopefuls that believe they can come out on top, Played on a PS3 gamers are vying for $16,700 in prize money in each of the games.

The MLG Pro Circuit has four full seasons that are each followed by a championship tournament. While players can compete over the course of the season online in a number of events, to play in the championships a player or team must be present.

This year the MLG signed an exclusive deal with CBS Interactive that made CBS Interactive the exclusive online broadcaster of the Pro Circuit. There is a good deal of speculation that CBS will broadcast events, or at least the fall championship going forwards.

StarCraft II

The games can and do change over the course of the year. For the spring championships players had StarCraft II: Wings of Liberty, League of Legends, Mortal Kombat 9, Soul Calibur V as well as The King of Fighters XIII. The online viewership reached 4.7 million unique viewers and had 20,000 fans in attendance in Anaheim. The fall event will take place in Dallas on Nov.2-4.

Watching NASCAR: No Groove at Bristol

A week after Jimmie Johnson had swept into the top of the Sprint Cup standings it looked as if he was about to add a bit of a lead to his position as he managed to reach the front of the pack at the Pure Michigan 400.

Leading with only nine laps to go was a major accomplishment for the driver that stared at the back of the race, and with a dominant car seemed destined to capture the checkered flag. Unfortunately his car decided to let him down and his engine failed with only six laps to go.

That opened the door for Greg Biffle, who not only won the race but took the points lead away, with Johnson dropping from 1st to 4th with his 27th place finish. Due to a late caution Biffle was forced to fend off Brad Keselowski, who came in second. Kasey Kahne came in third with Dale Earnhardt Jr. and Marcos Ambrose filling out the top five.

Next Up: Irwin Tools Night Race
The teams are in for a short track as they hit Bristol and its .533 mile oval for the Irwin Tools Night Race, in a race that has a lot of promise. It appears that the track has been resurfaced to make it harder to run side by side. This was accomplished by grinding down the concrete in order to remove the top groove. I expect it will add to the banging and bumping and with so many drivers so close to the wild card spots for the chase, an increase in driver internal temperatures.

What could be better that racing on a track that shares your last name and leading the race by almost 20 car lengths with a lap to go? I guess winning the race would rank right up there in the top position because failing to win was what Jacques Villeneuve did in Montreal.

He resorted to the tried and true, yet unproven, tactic of turning on and off his motor in an effort to preserve gas, and while it may have achieved that it failed to preserve the lead as Justin Allgaier managed to slip past for the win with a little bump to help thins out. He was then also passed by Sam Hornish Jr. fourth was taken by Elliot Sadler and Ron Fellows followed in fifth.

There was oddity during the race that I, and the announcers, have never seen. A fan offended by who knows what, threw a show onto the track, which was subsequently run over by then race leader Danica Patrick.
While she said over the radio immediately after hitting the shoe that she was having issues with her steering, her crew chief later said that the shoe had no relationship to the parts problems that dropped her from race leader to a 27th place finisher. NASCAR has said that it still has the shoe.

The Nationwide teams are again sharing the track with the Sprint drivers at the refurbished track in Bristol. It seems that in recent weeks there has been a bit of late bumping and with no top groove at Bristol, expect to see more of the same..

FundersClub Provides Crowdfunding for the Experienced Investor

FundersClub

A new challenger has risen to take on Kickstarter and the host of other crowd sourcing sites that have appeared over the last year or so, but it is one of the very few that offers actual equity in the companies that are using its platform. The FundersClub is an equity offering startup that used its own features to come into existence as it fully funded itself

It is also not as easy to use as the average crowdfunding site, where pretty much all you need is a buck and an Internet connection. Instead you have to be able to show that you are a serious investor with experience and funding.

That means that you have to be an individual that has a $200,000 annual income or greater or $300,000 with a spouse or investors with a net worth of $1 million or greater, not including primary residence. With that type of requirements it also separates itself from most of the existing crowdfunding sites.

It then has a list of investments that are available in individual funds and also offers investors the ability to invest across all active funds can use its FundersClub bundle feature. The primary types of companies that it will have funds for will be early, mid and late stage US hi-tech companies from around the nation.

It has several benefits that it touts for its investors including opening up funds that normally would not be available to even Angle investors due to the size requirements that they often have. It takes all of the individual investments in a single fund and bundles them it into what appears to be one single investment. When a distribution or liquidation of a company that a fund backs occurs th

e money is returned to FundersClub which then distributes the proceeds to the investors.

The site opens up private company stock and dept equity that might be difficult for small investors to access. It also provides a simple one stop investment site that handles screening, payments and documentation handling. There is a minimum investment of $1,000 and a maximum of $5,000 in a fund.

Currently FundersClub will operate at-cost, but over time it seeks to have a much fuller role in the market. It said that it will look to operate liquidity services for private companies, including employee liquidity program management for private companies, and eventually a trading platform for private companies that wish to provide ongoing private market liquidity to their shareholders.

I would not be surprised if after the JOBS Act, the law that basically enabled crowdfunding, finally gets a set of rules approved by the Securities & Exchange Commission others will also jump into the equity offering business.

The JOBS Act does not affect FundersClub because its requirements are ones that have been used for some time with accredited investors, the only real impact it might have is that once the rules are established it might open the program to the non-accredited investors that the act s designed to help.

One example of that is Fundable.org, which makes no mention of offering equity at first look on its web page but if you dig deeper you find that it has plans, at some point to do so, if it is allowed to do so after the SEC sets the rules.

One benefit I see from the formation of FundersClub is that it will be investing in more noteworthy companies. While I find a lot that I find amusing on Kickstarter, much of it seems to be rather frivolous. That could be in part simply because all of this is so new, or it could just be the nature of the crowd that uses that and similar sites.
